After submitting the application to the out-of-court mechanism, can the bank terminate the contract and seize it?
Applying to the out-of-court mechanism is not a reason to terminate a contract. However, a possible termination of a contract cannot be ruled out, as it is not prohibited by the enforced suspension of enforcement measures provided by law.
It is noted that the imposition of an account seizure or auction of property is excluded, as from the submission of the application until the completion of the procedure, the enforcement measures are suspended.
Exception: The suspension does not cover the auction, which is scheduled within three (3) months from the date of submission of the application by the debtor, as well as any procedural auction action by a secured creditor (including foreclosure).
